The conflicting orders emerged following actions by two separate judges:
- Order by Justice S.A. Amobeda (Federal High Court): Justice Amobeda issued an order to evict the Emir of Kano, Muhammadu Sanusi II, from the Kofar Kudu Palace, thereby enforcing the authority of the 15th Emir of Kano, Aminu Ado Bayero. The order also included an injunction to restrain authorities from infringing on Emir Bayero’s rights.
- Order by Justice Amina Adamu Aliyu (Kano State High Court): In contrast, Justice Aliyu issued an injunction protecting Emir Sanusi from eviction and restraining security agencies from harassing him or seizing symbols of his authority. This order aimed to maintain the status quo pending further legal proceedings.
The conflicting orders have created confusion regarding the rightful authority and protection of the emirs in Kano. To address this issue, the CJN has intervened by summoning the respective judges for clarification.
While the State High Court case is scheduled for further hearing on June 13, the Federal High Court has adjourned its case to June 4. This development underscores the need for judicial harmony and clarity in resolving the complex legal issues surrounding the Kano Emirate tussle.
