The family of the late former Chairman of the Nigerian Exchange Group, Abimbola Ogunbanjo, who tragically lost his life in a Southern California helicopter crash in February, has taken legal action against the US helicopter company involved. The Ogunbanjo family alleges that the flight should have been grounded due to treacherous weather conditions. According to reports, the charter company, Orbic Air, is accused of improperly flying the helicopter despite adverse snowy and rainy conditions in the Mojave Desert, where the crash occurred on Feb. 9.

One of the attorneys handling the lawsuit, Andrew C. Robb, emphasized that Ogunbanjo’s family seeks “answers and accountability.” He highlighted the risk of flying helicopters in snowy and icy conditions, stressing that the flight was entirely preventable.

Ogunbanjo’s wife and two children have filed a lawsuit in San Bernardino County Superior Court against Orbic Air and its CEO, Brady Bowers, citing wrongful death and negligence. The suit also implicates the unidentified successors of Pettingill and Hansen, whom Ogunbanjo’s family holds responsible for the tragedy. Orbic Air has yet to comment on the matter.

The National Transportation Safety Board is currently investigating the crash, with a preliminary report revealing details about the helicopter’s flight path and the conditions at the time of the accident. Witnesses reported witnessing a “fireball” during the rainy and snowy weather.

The lawsuit seeks a jury trial to cover Ogunbanjo’s burial and funeral expenses, along with other damages. Robb & Robb, the law firm representing Ogunbanjo’s family, has previously handled high-profile cases, including representing Vanessa Bryant in her lawsuit following Kobe Bryant’s fatal helicopter crash in 2020.

  • Plaintiffs Accused of Misleading the Court: The APC argued that Atiku and the ADC proceeded with the substituted-service application on September 16 “without drawing the court’s attention to the fact that the 1st Defendant (Tinubu) had already filed and served his defence.”

  • Lack of Authority: The ruling party also emphasized that it had no authorization from President Tinubu to accept court documents on his behalf.

The original suit, filed in August 2026, seeks the disqualification of President Tinubu and the APC from the 2027 presidential election over allegations concerning the President’s National Youth Service Corps (NYSC) discharge certificate.

Despite this procedural conflict, the APC affirmed that both the party and the President have filed their responses and are fully “prepared to proceed with the case.”
