The legal battle began when the Tribunal, in a November 2023 ruling, granted an ex parte order allowing the SDP and its gubernatorial candidate to conduct a forensic examination of all the Bimodal Voters Accreditation system (BVAS) used in the election, among other reliefs. However, this decision faced challenges when a three-man panel of justices of the Court of Appeal set aside the inspection order on March 1, 2024.
Nevertheless, the Supreme Court, in a unanimous decision delivered by Justice Emmanuel Akomoye Agim, reinstated the Tribunal’s order, dismissing the decision of the Court of Appeal. Justice Agim emphasized that the order of the trial court was within the scope of section 146 of the Electoral Act, affirming the SDP candidate’s right to inspect election materials.
