The decision was made by Justice Abdullahi Muhammad Liman during a fundamental rights enforcement case brought by Ganduje against the commission.

Recall that Ganduje currently serves as the national chairman of the All Progressives Congress (APC). He initiated the lawsuit in July 2023 to protect his fundamental rights after the commission’s chairman, Muhyi Magaji Rimin Gado, called him to appear and respond to inquiries related to the dollar bribery video.

The court issued an injunction preventing Ganduje from being summoned or investigated until the case is conclusively resolved.

The dollar bribery video, released by an online publication, Daily Nigerian, in 2018, allegedly showed Ganduje, then governor, receiving stacks of dollars from a contractor. However, Ganduje denied the allegations, asserting that the video had been manipulated.

The commission, represented by a Lagos-based human rights lawyer, Femi Falana, argued that it had initiated an investigation into the bribery video in 2018 but was unable to conclude its investigation due to Ganduje’s immunity at the time.

Ganduje, in his affidavit, refuted accusations of embezzling public funds and acquiring property for himself or his associates.

Justice Liman determined that the alleged offence being investigated by the commission was a federal crime, emphasizing that federal offences fall under the jurisdiction of federal agencies such as the EFCC.

Furthermore, Justice Liman upheld Ganduje’s rights to dignity of the human person, a private and family life, and to acquire and own property.

The PCACC’s counsel expressed concern over the delay in delivering the court’s judgment and indicated plans to appeal. Conversely, Ganduje’s counsel affirmed the court’s interpretation of the law, stating that the judgment affirmed his client’s position regarding the commission’s jurisdiction.
