The ruling came as a result of an application for restraining orders filed by rights activist Olukoya Ogungbeje. Justice Ambrose Lewis-Allagoa, the trial judge, granted the application on February 22, 2024.
In the lawsuit, Ogungbeje took the federal government, the Attorney General of the Federation and Minister of Justice, MTN Nigeria Communications Plc, and Airtel Networks Nigeria Limited to court. He sought an injunction pending appeal, preventing all respondents from enforcing the judgment or taking any action to restrict SIM cards or phone lines of Nigerian citizens.
Ogungbeje presented ten grounds for seeking the application, including the contention that the respondents’ actions undermined the judicial powers of the court and infringed on his fundamental rights.
The court’s decision was based on the appellant’s dissatisfaction with a previous judgment delivered on May 8, 2023, which dismissed his suit. Ogungbeje lodged a notice of appeal against the judgment, exercising his constitutional right to appeal.
This ruling temporarily prevents telecom operators from implementing any measures to deactivate or block SIM cards or phone lines until further legal proceedings are concluded
