Justice James Omotosho set the date after hearing arguments from both parties involved in the case.

Mr. Uchenwa, an elder of the church, contends that scheduling elections and exams on Saturdays violates his and fellow church members’ freedom of worship rights. He argues that it compels them to choose between adhering to their religious beliefs and engaging in civic duties or educational activities.

He seeks a court declaration labeling the fixing of elections and exams on Saturdays as unconstitutional. Alternatively, he requests that the court orders the defendants to permit him and other church members to vote or take exams on any other day, including Sundays.

The defendants, including the President, the Attorney-General of the Federation, the Minister of Internal Affairs, INEC, JAMB, NECO, WAEC, NABTEB, Council of Legal Education, and the Ministry of Education, oppose the lawsuit. They assert that Nigeria is a secular state with no official religion adopted. Therefore, accommodating specific religious practices of one group would infringe on the rights of others.

During the hearing, plaintiff counsel Mr. Benjamin Amaefule informed the court that his client sought the enforcement of his fundamental rights to freedom of education and worship. He asserted that the scheduling of exams and elections on Saturdays violated these rights for Seventh-day Adventist Church members in Nigeria.

Amaefule requested various reliefs, including a declaration that fixing exams on Saturdays infringes on the fundamental rights of freedom of conscience, profession, and faith of the church members. He also asked for an injunction restraining INEC from conducting elections on Saturdays for church members or mandating INEC to provide an alternative day for their participation.

In summary, the court will deliver its judgment on March 20, determining whether the scheduling of elections and exams on Saturdays violates fundamental rights.

“Unless we are able to resolve these two challenges, then I don’t see the fusing together being possible. However, even if they do not fuse together, individually, anyone of them has the capacity to upturn the order, depending on how he strategises himself.

“So, even if they don’t, they still have the capacity to win the election against the incumbent on an individual basis.”
