Justice James Omotosho fixed the date after hearing arguments from both parties involved.

Mr. Uchenwa, an elder of the church, asserts that scheduling elections and examinations on Saturdays infringes on his and other church members’ rights to freedom of worship. He contends that this practice compels them to choose between their religious beliefs and engaging in civic duties or educational opportunities.

He is requesting the court to declare the scheduling of elections and examinations on Saturdays as unconstitutional. Alternatively, the plaintiff is asking the court to instruct the defendants to permit him and other church members to vote or take examinations on any other day of the week, including Sundays.

The defendants, including the President, the Attorney-General of the Federation, the Minister of Internal Affairs, the Independent National Electoral Commission (INEC), the Joint Admission and Matriculation Examinations (JAMB), the National Examination Council (NECO), the West African Examination Council (WAEC), the National Business and Technical Examination Board (NABTEB), Council of Legal Education, and the Ministry of Education, are opposing the lawsuit.

They argue that Nigeria is a secular state with no officially adopted religion. Therefore, they contend that compelling them to accommodate the specific religious practices of one group would violate the rights of others.

During Wednesday’s hearing, the plaintiff’s counsel, Mr. Benjamin Amaefule, informed the court that his client is merely seeking the enforcement of his fundamental right to freedom of education and the freedom to participate in elections.
