Just In: Federal High Court Receives SERAP Lawsuit On INEC’s Handling Of Off-Cycle Elections

In the lawsuit with reference number FHC/ABJ/CS/1694/2023, filed last Friday at the Federal High Court in Abuja, SERAP is requesting the court to issue a mandamus order directing INEC to investigate allegations of electoral offenses, including electoral violence, in the aforementioned states. SERAP also seeks mandamus orders compelling INEC to promptly and effectively prosecute those suspected of grave electoral offenses and disclose detailed spending information on the off-cycle governorship elections in Kogi, Imo, and Bayelsa States.
In its argument, SERAP contends that there is a genuine public interest in holding individuals accountable for the serious electoral offenses committed in the mentioned states. The relief sought, according to SERAP, would enforce INEC’s constitutional and statutory obligations and put an end to the impunity of electoral offenders.
SERAP further asserts that the recurring instances of electoral bribery and violence undermine Nigeria’s electoral process and participatory democracy. It criticizes INEC for not learning from documented issues during the 2023 general elections and emphasizes that INEC has a constitutional duty to ensure accountability for electoral offenses and safeguard citizens’ right to vote in future elections.
The lawsuit, filed by SERAP’s legal representatives Kolawole Oluwadare and Andrew Nwankwo, argues that the right to vote is fundamental to a democratic society, and any infringements on that right undermine representative government. The persistent occurrence of electoral offenses in Nigeria violates citizens’ right to vote, impeding effective citizen participation in the electoral process.
As of now, no specific date has been set for the hearing of the lawsuit.

In an interview, Tanko reaffirmed that Obi will contest the 2027 presidential election, but stressed that no official statement has been made regarding the platform he will use.
He said he could not make any confirmation or denial until an official announcement is released.
According to him, “Well, I would neither confirm nor deny at the same time until such a pronouncement is made officially.
“What I want to tell Nigerians is that His Excellency, Peter Obi, has continuously been saying that he will be on the ballot to run for the office of the President of the Federal Republic of Nigeria. I believe in him, and I want Nigerians to believe that as well.
“What I said is clear: I said he will run on a platform. I did not say which platform.”
His remarks come amid increasing speculation about Obi’s political future ahead of the 2027 general elections. Although the former Labour Party presidential candidate has consistently stated his intention to run again, the political platform he will use remains uncertain.
