BREAKING: SERAP Takes Legal Action Against INEC Over Alleged Failure To Prosecute Electoral-Offenders

The lawsuit, bearing the number FHC/ABJ/CS/1694/2023, was officially submitted last Friday at the Federal High Court in Abuja. SERAP is seeking “an order of mandamus” to instruct and compel INEC to investigate allegations of electoral offenses, including electoral violence, during the off-cycle governorship elections in the aforementioned states.
Additionally, SERAP is pursuing an order of mandamus to force INEC to disclose spending details related to the off-cycle governorship elections in Kogi, Imo, and Bayelsa states. This includes specific amounts spent on voter and civic education, as well as details of activities conducted in the three states.
SERAP contends that addressing these matters is in the public interest, ensuring accountability for severe electoral offenses. The relief sought, if granted, aims to enforce INEC’s constitutional and statutory responsibilities and curtail the impunity of electoral offenders.
Highlighting the prevalence of electoral bribery and violence, SERAP expressed concern that these incidents undermine Nigeria’s electoral process and participatory democracy. The organization emphasizes that compelling INEC to arrest and prosecute suspected electoral offenders is crucial to ending the cycle of impunity for such crimes in Kogi, Imo, and Bayelsa states.
