Chief Emeka Ngige (SAN), representing the Body of Senior Advocates of Nigeria (BOSAN), disclosed this information during a Special Court session held in honor of the late Justice Edith Nneka Neolita Agbakoba. Ngige, who serves as the current chairman of the Council of Legal Education, revealed that the committee includes heads of federal and state courts, the president of the National Industrial Court, Benchers from BOSAN, and retired judicial officers who are Benchers.
Ngige highlighted the escalating issue of conflicting judgments, particularly in pre-election and post-election litigation, emphasizing its detrimental impact on the established doctrine of stare decisis. He praised the Body of Benchers for its timely intervention and expressed optimism that the committee’s efforts would yield a lasting solution to curb this troubling trend.
The legal luminary stressed the importance of widely publicizing the committee’s work to solicit input from members of the legal profession, the Bench, and the public who may have valuable suggestions to address the issue. Ngige acknowledged the longstanding commitment of the Nigerian legal profession to the doctrine of stare decisis and underscored its significance in providing certainty to the law.
Ngige recounted past efforts to address the issue, including the establishment of a committee in January 2019 by BOSAN. He lamented the delayed action on the committee’s recommendations due to the forced exit of the then Chief Justice of Nigeria, Justice Walter Onnoghen. The recent decision by the Body of Benchers to set up a high-powered committee underscores the escalating concern about conflicting judgments, prompting a renewed effort to find a solution.
