The letter, dated December 14, 2023, titled “NOTICE OF VACANCIES IN THE RIVERS STATE HOUSE OF ASSEMBLY PURSUANT TO SECTION 109(1)(G) AND (2) OF THE CONSTITUTION OF THE FEDERAL REPUBLIC OF NIGERIA 1999 (AS AMENDED) AND REQUEST FOR CONDUCT OF FRESH ELECTIONS IN THE 25 STATE CONSTITUENCIES IN THE RIVERS STATE HOUSE OF ASSEMBLY,” highlights the defection of members from the Peoples Democratic Party (PDP) to the All Progressives Congress (APC) on December 11, 2023.
The letter explains that, based on Section 109(1) (g) of the Constitution, these members’ seats were declared vacant through a resolution passed during the 90th Legislative Sitting on December 13, 2023. The Speaker, acting on behalf of the Rivers State House of Assembly, formally seeks the conduct of a bye-election to fill the vacant seats.
The defection of 27 lawmakers, led by Martins Amaewhule, from the PDP to the APC, prompted swift action from Governor Siminalayi Fubara’s camp. Legislators loyal to the governor declared the defectors’ seats vacant. Amaewhule’s faction is purportedly supported by Nyesom Wike, intensifying the ongoing power struggle between Wike and Fubara for control of the state’s political structure.
Notably, the State High Court in Port Harcourt recently issued an order allowing the four-member Rivers House of Assembly backed by Fubara to conduct legislative business without interference. Simultaneously, the state government, in the same week, ordered the demolition of the assembly complex, citing concerns about structural defects.
