Pinheiro expressed this viewpoint during a public presentation of a book co-authored by Lagos State Attorney-General and Commissioner for Justice, Lawal Pedro (SAN), on Wednesday evening. The book, titled “The Supreme Court of Nigeria: History, Establishment, Jurists and Speeches,” was co-authored by Abdulrasheed Ibrahim.
In his address, Pinheiro drew attention to the fact that each state in the United States has its own supreme court and emphasized the need for states in Nigeria to establish their own supreme courts as a testament to a genuine commitment to federalism.
He questioned the logic of certain cases, such as matrimonial matters and customary law cases, reaching the Supreme Court of Nigeria. Pinheiro argued against the impracticality of a Supreme Court judge, hailing from one state, making decisions on issues related to the customary laws of another state.
To address the heavy caseload in the Supreme Court of Nigeria, Pinheiro proposed limiting the court’s jurisdiction to appeals arising exclusively from matters within the purview of federal courts, including the Federal High Court and the National Industrial Court. Additionally, he recommended improvements in the working conditions, healthcare services, and remuneration for judicial officers, emphasizing the necessity for the appointment of more justices to the Supreme Court.
Pinheiro further suggested amending the 1999 Constitution to allow for the termination of specific appeals at the Court of Appeal, asserting that certain matters, such as divorce cases and tenancy disputes, should not be within the purview of the Supreme Court. He underscored the importance of enhancing the independence of the judiciary in this context.
