Supreme Court Receives Nine-Grounds Of Appeal From Sokoto’s PDP Gubernatorial Candidate (Details)
The gubernatorial candidate of the Peoples Democratic Party (PDP) for the 2023 general elections in Sokoto State, Sai’du Umar, has initiated an appeal at the Supreme Court, challenging the judgments of both the Elections Petition Tribunal and the Court of Appeal. The appeal, shared with our correspondent by the candidate’s media assistant, Nafiu Lema, argues that the “judgment of the Court of Appeal is against the weight of evidence” and thus should be nullified by the highest court. The Court of Appeal had, in a unanimous decision the previous month, declared that the appellants failed to substantiate allegations of irregularities, noncompliance, and non-qualification outlined in their appeal.
Justice Mbaba Bassi, delivering the lead judgment, affirmed the tribunal’s decision to discard evidence of non-compliance and alleged irregularities due to incompetence in witness presentation. Bassi emphasized that the appellants’ failure to list and front-load the statements of the witnesses critically impacted their case.
The appellants had presented INEC’s form EC40G (incident form), indicating election cancellations due to over-voting or disruption. However, the appellate court noted that the form demonstrated that voters were allowed to cast their votes, but issues arose leading to the cancellation of the election.
Justice Bassi, while acknowledging that oral evidence might not be necessary under Section 137 of the Electoral Act, pointed out that precedent set by higher courts required the appellants to lead oral evidence to support their allegations of vote manipulation through the cancellation of elections in 138 polling units.
Additionally, the election petitions tribunal, chaired by Justice Haruna Msheila, had earlier dismissed the PDP’s petitions on September 30, stating that the petitioners failed to prove the six formulated grounds, including allegations of ineligibility, certificate falsification, name variation, election fraud, and non-compliance with electoral guidelines. The tribunal found the evidence inconclusive and emphasized the lack of substantial non-compliance affecting the election outcome in the alleged 138 polling units.

Ajibola, widely known as Baba Isila, was ambushed along with his associates around 9:50 pm near the Community Bank in the MDS area. Eyewitnesses reported that suspected gunmen opened fire on a blue Toyota Corolla carrying Ajibola and his friends.
One occupant of the vehicle described the terrifying ordeal, stating that the attackers chased their car while firing repeatedly. They managed to drive to the Dugbe Divisional Police Headquarters for refuge, after which the assailants fled the scene.
Ajibola sustained severe injuries in the attack and was immediately rushed to the UNIOSUN Teaching Hospital, Osogbo, where he remains in critical condition.
The Osun State Commissioner for Information and Public Enlightenment, Kolapo Alimi, strongly condemned the violence and demanded a swift, thorough investigation. He stressed that the attack appeared to have political undertones and urged the police to act professionally and impartially to bring the perpetrators to justice.
