Constitutional lawyer Daniel Bwala raised concerns on Monday, asserting that the authority of the Supreme Court, recognized as the final court in the land, has been brought into question by the Court of Appeal’s decision on the Plateau State elections. Bwala questioned why the Court of Appeal decided to assert jurisdiction in Plateau State while simultaneously respecting the apex court’s authority in similar cases. He emphasized that the upcoming case in the Supreme Court would essentially pit the Supreme Court against the Court of Appeal.
The lawyer highlighted the importance of the Supreme Court clarifying whether its judgment delivered in the Presidential Election Tribunal should be adhered to by subordinate courts in Nigeria. Bwala emphasized the principle that decisions by a final court are considered settled law, and the Supreme Court must determine whether it or the Court of Appeal holds the higher authority.
Expressing concern over the potential impact on public confidence in the judiciary, Bwala pointed out the need for consistency, citing instances where other courts obeyed the Supreme Court’s judgment but the Court of Appeal deviated in Plateau State. He referred to historical practices, mentioning the days of Justice Tobi when the Supreme Court would reprimand lower courts for disregarding their judgments.
