Activist lawyer Ebun-Olu Adegboruwa (SAN) addressed a Lagos Coroner on Friday, October 20, suggesting that an impartial team of experts should conduct the autopsy on the late Adebola Akin-Bright’s body. Akin-Bright, a 12-year-old boy, lost his small intestine following surgery at LASUTH, Ikeja, recently.

Adegboruwa emphasized the need for experts from independent bodies like the Nigerian Medical Association (NMA) to examine the deceased’s remains to prevent potential bias and conflicts of interest, given the circumstances surrounding Akin-Bright’s death at Lagos State University Teaching Hospital (LASUTH), Ikeja.

These statements were made as the proceedings commenced into the inquiry surrounding the death of Master Akin-Bright, who passed away at LASUTH. The Coroner Court, presided over by District Coroner Magistrate Mrs. Bola Folarin-Williams, is situated at Magistrate Court 4, Botanical Gardens, Ebute-Metta.

During the proceedings, Ebun-Olu Adegboruwa, alongside Mr. Aramide Adeogun and Mr. Ezekiel Nnadi, represented the father of the deceased, Olumuyiwa Akin-Bright, who filed the complaint. Abiodun Kolawole represented the African Women Lawyers Association, while Mr. O.A. Akinde, a state counsel from the Ministry of Justice, represented the Lagos State Government as an interested party.

The state counsel, Akinde, informed the court that necessary tests and examinations had been conducted on the corpse, including a post-mortem report. He also mentioned that the Attorney General’s office was aware of solicitors’ letters seeking to either preserve the corpse or release it for burial, depending on the wishes of the deceased’s parents. Adegboruwa, on the other hand, expressed the need to call several witnesses, including the medical director of Hobitox Medical Centre and doctors from LASUTH who treated the deceased, as well as the investigating police officers.

The Coroner mentioned that the autopsy report would soon be available to the court and suggested that the parents file their respective applications regarding the disposition of the deceased’s body. Adegboruwa revealed that he intended to liaise with Mr. Femi Falana, SAN, who was leading the mother’s legal counsel, to harmonize their perspectives. However, he stressed the importance of preserving the body as the Coroner had already assumed jurisdiction over the case.

Counsel representing the state, Akinde, assured the Coroner that the state would cooperate and provide all witnesses and documents, including medical personnel’s testimonies from LASUTH.

The Coroner clarified that the inaugural sitting was for preliminary proceedings and instructed the parties to meet, harmonize their views, and submit a list of witnesses before the next hearing. She also requested that the autopsy report and all relevant documents be shared with the parties. The case was adjourned to November 24, 2023, for further proceedings.
