Atiku Abubakar, the 2023 presidential candidate of the Peoples Democratic Party (PDP), has filed an application with the Supreme Court, requesting that technicalities be set aside in order to allow the presentation of fresh evidence in support of his case against President Bola Tinubu.
It is worth recalling that Atiku had previously submitted a notice of plea to the Supreme Court, alleging that President Tinubu had submitted a forged document to the Independent National Electoral Commission (INEC) for the February 25 presidential election.
Atiku’s plea was based on the assertion that the presentation of forged documents by any candidate, particularly a candidate for the highest office in the country, is a serious constitutional matter that should not be condoned.
President Tinubu, on the other hand, urged the Supreme Court to dismiss Atiku’s request for leave to introduce fresh evidence, citing issues of jurisdiction and the pre-election nature of the matter. He implored the court to deny the application.
In response, Atiku argued that matters of merit should not be determined or pronounced upon at the interlocutory stage, emphasizing that their current request was solely for leave to present new evidence. He stressed that refusing to grant the requested leave, as argued by the respondents, would be overly technical.
Atiku cited previous Supreme Court cases that intervened to ensure substantial justice in cases of great constitutional significance, highlighting the need to reject technicality and uphold the duty of the court to ensure substantial justice.
In his application, Atiku contended that if the Supreme Court grants the application, there would be no need for further argument, as the evidence would demonstrate that the second respondent (Tinubu) violated the provisions of Section 137(1)(j) of the Constitution by presenting a certificate disclaimed by the institution from which he purportedly obtained it.
He further argued that Tinubu’s objection to admitting the new evidence was without merit, as he was represented throughout the discovery and deposition process as well as during the court hearing by his attorneys. Atiku also dismissed Tinubu’s claim of inconsistency in names, deeming it immaterial and irrelevant, as there is no petition challenging his qualification. Furthermore, he emphasized that the presentation of a forged certificate disqualifies a candidate permanently, regardless of when it was presented.
