The Socio-Economic Rights and Accountability Project (SERAP) has urged the Senate President, Godswill Akpabio, and the Speaker of the House of Representatives, Tajudeen Abbas, to oppose the recently reintroduced social media regulation bill. The bill, if passed, could restrict the rights to freedom of expression and privacy.

This request from SERAP was conveyed in a letter dated October 14, 2023, signed by SERAP’s deputy director, Kolawole Oluwadare. The organization called on Akpabio and Abbas to urge President Bola Tinubu’s administration to refrain from pressuring Google, YouTube, TikTok, and other social media companies to unduly restrict fundamental human rights.
SERAP emphasized that the bill could criminalize the legitimate and lawful exercise of human rights. The National Broadcasting Commission (NBC) recently described social media as “a monster” and cited it as one of Nigeria’s major problems.
In response, SERAP stated that social media is not Nigeria’s problem and any regulation of it would have arbitrary and excessive effects, causing significant damage in material and human rights terms. SERAP argued that such regulation would be inconsistent with the Nigerian Constitution 1999 and international human rights obligations.
SERAP pointed out that the proposed bill raises serious concerns about the rights to freedom of expression and privacy, potentially leading to a digital siege. The organization urged the National Assembly to encourage the Federal Government to maximize social media access and address social and economic inequalities, rather than rushing to pass the regulation bill.
SERAP warned that they would take legal action against the National Assembly and the Federal Government if the social media regulation bill is passed into law. The organization also urged Akpabio and Abbas to request President Bola Tinubu’s administration to make public any ongoing discussions and engagements with social media companies.
They stressed that the reintroduction of the social media regulation bill could worsen the human rights situation in the country and have significant economic costs while deepening digital divides. SERAP urged the government to comply with constitutional and international human rights obligations regarding freedom of expression, privacy, and participation. Access to social media is viewed as essential for a wide range of human rights and should not be unduly interfered with, according to the organization.
