Extradition: Pay Kanu N500m, Court Orders FG.
The Federal Government must pay Nnamdi Kanu, the leader of the Indigenous People of Biafra, N500 million in damages after his illegal kidnapping and violations of his human rights, according to a decision from a Federal High Court in Umuahia, the capital of Abia State.....KINDLY READ THE FULL STORY HERE▶
The Federal Government was also mandated by the court to send the man back to Kenya, from which he was extradited to Nigeria on June 19, 2021.
Kanu was extradited from Kenya without going through the proper legal channels, according to the court presided over by Justice E.N. Anyadike, and this was a gross violation of his basic human rights.
On June 19, 2022, Kanu filed a court petition opposing his extradition from Kenya through his counsel, Aloy Ejimakor.
Ejimakor explained to the court that the lawsuit was sui generis (of a special class) and that Kanu’s unlawful expulsion or extraordinary rendition was a clear violation of his fundamental rights as stated in Article 12(4) of the African Charter on Human and Peoples’ Rights and Chapter IV of the Nigerian Constitution.
Ejimakor stated that the judgment proved that the court is still the common man’s only option in a press conference shortly after the decision.
Kanu is requesting N100bn in restitution for the abuse of his rights in the interim.
The IPOB leader is seeking a declaration that the Federal Government’s reluctance to release him from custody despite the order of the Court of Appeal in a lawsuit that was filed at the Federal High Court of Abuja through his legal team, led by Chief Mike Ozekhome (SAN) and Ifeanyi Ejiofor.
In the lawsuit with the file number FHC/ABJ/CS/1945/2022, the Federal Republic of Nigeria, the Attorney-General of the Federation, the State Security Service, and its Director General are listed as the first through fourth respondents.
Kanu claims the lawsuit is based on the Federal Government’s reluctance to follow the appellate court’s order issued on October 13 that discharged him of the terrorism charge brought against him and thus a violation of his fundamental rights.
In addition, Kanu is suing the respondents for N100 billion in compensatory and punitive damages for the flagrant breach of his human rights to dignity, personal freedom, and freedom of movement.
Kanu is also asking the court to issue a directive for the respondents to publish an unqualified apology in two national publications.
