Non-conduct Of LG Polls: Court Order Challenges Soludo Administration
Last week, a High Court of the Federal Capital Territory, Abuja, issued an order halting the federal government from transferring funds to Anambra State’s 21 local government councils under the administration of Governor Chukwuma Soludo. The court also instructed the Economic and Financial Crimes Commission (EFCC) to investigate Anambra State Government officials regarding the use of funds received from March 22, 2022, to April 30, 2024, the duration of Soludo’s governorship. The EFCC is required to submit a compliance affidavit and an investigation report within 30 days.
This order follows a suit filed by lawyer Chukwuebuka Mmeni, Esq. The court’s decision came just after Governor Soludo dismissed all transition committee chairmen of local government councils. These chairmen, appointed in April 2022, were initially meant to serve for three months, pending local government elections promised in Soludo’s 2021 campaign. However, their terms were renewed seven times without elections being held.
Soludo’s dismissal of the chairmen was seen as a positive step by those advocating for local government elections. Yet, disappointment followed as Soludo sought nominations from All Progressives Grand Alliance (APGA) leaders to replace the sacked chairmen, highlighting the absence of a State Independent Electoral Commission in Anambra.
Critics, including Hon. Afam Ogene, representing Ogbaru Federal Constituency, condemned Soludo’s repeated appointment of interim local government administrators. Ogene criticized the lack of democratic elections, which he argued stifles development and transparency. He called for a halt to this practice, emphasizing the constitutional importance of local governments.
Valentine Ozigbo, a Labour Party chieftain and former governorship candidate, accused Soludo of corruption, alleging misuse of federal allocations meant for local governments to bolster his political structure. Ozigbo suggested that the recent court order might force Soludo to conduct local elections.
The last local government election in Anambra was held in 2012 under Peter Obi. Soludo’s campaign promise to reinstate functional local governance has remained unfulfilled, despite repeated assurances.
Ozigbo remarked on the significant funds allocated to Anambra’s local governments, criticizing their mismanagement and calling for genuine local elections. He lauded Chukwuebuka Mmeni for seeking the court order and urged the state government to avoid legal battles and instead focus on conducting elections.
There are signs of impending local government elections. The Anambra State House of Assembly recently passed a bill to establish the Anambra State Independent Electoral Commission, which awaits the governor’s assent.
APGA National Chairman Sly Ezeokenwa defended the administration, stating that the governor is committed to local government elections. Ezeokenwa mentioned Soludo’s initiative to involve communities as a new tier of government, emphasizing the administration’s steps to enhance local governance.
Soludo’s government is working to overcome obstacles, including the re-establishment of the state electoral commission, to pave the way for local elections.
