The court also directed the police to ensure that all rights and privileges due to the 15th Emir of Kano, Aminu Bayero, are upheld. This decision follows the deposition of Emir Bayero last week after the passage and assent of the amended Kano Emirate Council bill by Governor Abba Kabir Yusuf.
Presiding over the matter, Justice S. A. Amobeda emphasized that the ex parte order was issued in the interest of justice and the maintenance of peace in Kano. The court’s order includes:
- Interim Injunction: Preventing the respondents, including their agents and representatives, from inviting, arresting, detaining, or harassing the applicant, as well as from raiding, tampering with, or visiting the applicant’s residence with the intent to arrest or infringe on his rights, pending the hearing and determination of the originating motion.
- Rights and Privileges: Restraining the respondents from denying the applicant the use of his official residence and palace at the Emir’s Palace, Kofar Kudu, and ensuring the enjoyment of all rights and privileges associated with the position of Emir of Kano State. This includes evicting any illegal occupants residing within the palace.
The court has adjourned the hearing of the suit to June 4, 2024.
This ruling follows shortly after a state high court, presided over by Justice Amina Adamu Aliyu, granted an order restraining the eviction of Emir Sanusi II, highlighting the complex legal and political struggle over the emirship in Kano.
CISLAC Warning
The Civil Society Legislative Advocacy Centre (CISLAC) has warned that the ongoing tussle over the Kano emirship could lead to anarchy if not addressed. The organization has called for a peaceful resolution to the conflict, stressing the importance of maintaining stability and harmony in the region.
Background
The emirship crisis in Kano escalated when the amended Kano Emirate Council bill was passed into law, leading to the deposition of Emir Aminu Bayero. This move reinstated Muhammadu Sanusi II, whose reinstatement has been met with legal challenges and political resistance.
The situation remains fluid, with courts issuing conflicting orders and stakeholders expressing concerns over the potential for unrest. As the legal battles continue, the people of Kano and the broader region watch closely, hoping for a resolution that upholds justice and maintains peace.
