The three-member panel of justices, led by Justice Ado Birnin-Kudu, unanimously dismissed the petition filed by the Social Democratic Party (SDP) and its candidate, Murtala Ajaka. The tribunal concluded that the petition lacked substance, citing the failure of the petitioners to substantiate their allegations of over-voting and non-compliance with the Electoral Act, 2022.

The tribunal found the witness evidence presented by the petitioners to be incompetent and riddled with inconsistencies. Furthermore, the panel concurred with the respondents’ arguments that the forgery allegations raised by the petitioners were a pre-election issue, which should have been addressed within 14 days after the relevant documents were submitted to the Independent National Electoral Commission (INEC).

The News Agency of Nigeria (NAN) reported that the off-cycle election held on November 11, 2023, saw Ododo of the APC emerge victorious, defeating his closest rival, Ajaka of the SDP, by a significant margin. Dissatisfied with the result, Ajaka filed a petition challenging Ododo’s victory.

The tribunal proceedings, which began in December 2023, reached a crucial point on May 13 when all parties, including the SDP, Ajaka, APC, Ododo, and INEC, presented their final written addresses. Subsequently, the tribunal reserved its judgment.

Throughout the case, INEC, Ododo, and the APC, represented by their legal teams led by Chief Kanu Agabi, SAN, Joseph Daudu, SAN, and Emmanuel Ukala, SAN, respectively, consistently urged the tribunal to dismiss the petition for being incompetent and lacking merit. Conversely, Ajaka’s lawyer, Pius Akubo, SAN, argued for the tribunal to uphold the petition.

Today’s ruling solidifies Usman Ododo’s position as the elected governor of Kogi State, reaffirming the legitimacy of the November 2023 election and dismissing the challenges posed by Ajaka and the SDP
