The government’s intention to establish a modern transport terminal in the location has sparked controversy, with stakeholders, including federal and state lawmakers, expressing opposition to the move. Despite public outcry, the government remained silent, prompting the legal action.

In the lawsuit marked No. N/73/2024, the plaintiffs seek a court order compelling the state government to pay damages amounting to N50 billion as compensation to those affected by the demolition. The suit names the state Governor, Peter Ndubuisi Mbah, and the Attorney General of the state as respondents.

The litigants argue that the planned demolition constitutes a gross violation of fundamental rights and threatens the livelihoods of over 10,000 traders in Ogige Market, Nsukka. They seek a perpetual injunction restraining the government from harassing, intimidating, or further infringing on the rights of the traders.

Counsel to the applicants, Olu Omotayo, highlighted the significant investments made by traders in the market over the past 50 years, amounting to over N10 billion. He described the government’s actions as reminiscent of the military era, emphasizing the peaceful coexistence of traders in the market before the sudden issuance of the demolition notice.

The applicants urgently petition the court to halt the demolition and prevent further violations of traders’ rights pending the resolution of the legal dispute.
