Governor Yusuf had earlier issued an order for the immediate arrest of the deposed Emir, Aminu Ado Bayero, accusing him of disturbing public peace and attempting to destabilize the state’s relative calm. The directive was announced in a statement by the governor’s spokesperson, Sanusi Bature Dawakin Tofa.

The statement from the governor’s office read: “The former Emir was smuggled into Kano city last night in an attempt to forcefully return to the palace two days after being deposed by the Governor. As the Chief Security Officer of the state, His Excellency, the Executive Governor of Kano State, Alhaji Abba Kabir Yusuf, has directed the Commissioner of Police to arrest the deposed Emir with immediate effect for disturbing public peace and attempting to destroy the relative peace the state enjoys.”

However, Commissioner Gumel clarified that no official communication had been received regarding the governor’s instruction to arrest Aminu Ado Bayero. He emphasized that the police, in collaboration with military and other security agencies, are committed to upholding a court order.

The legal context involves a Federal High Court in Kano issuing an order to halt the enforcement of the Kano State Emirate Council Repeal Law, following an application by Alhaji Aminu Babba Dan Agundi, the Sarkin Dawaki Babba of the Kano Emirate. This order came amid the dissolution of four newly created emirate councils—Rano, Karaye, Gaya, and Bichi—by the Kano State House of Assembly, which was part of the repeal of the Kano State Emirs (Appointment and Deposition) Law.

Governor Yusuf recently reappointed Lamido Sanusi as the Emir of Kano, four years after his dethronement by former governor Umar Ganduje. In a sweeping move, the governor also deposed five emirs appointed by Ganduje, giving them a 48-hour ultimatum to vacate their official residences and hand over their duties to the Commissioner for Local Government and Chieftaincy Affairs.

The respondents in the legal case concerning the Emir’s seat include the Kano State Government, the House of Assembly, the Speaker, the Attorney-General, the Commissioner of Police, the Inspector-General of Police, the Nigeria Security and Civil Defence Corps, and the State Security Service. Justice Mohammed Liman ordered that all parties maintain the status quo pending the hearing of the fundamental rights application, thereby temporarily halting the enforcement of the new law and maintaining the existing state of affairs in the emirate council.
