EFCC’s Position: The Commission is seeking the permanent forfeiture of the properties—valued at over ₦212 billion and situated in Abuja, Kano, Kebbi, and Kaduna—claiming they are proceeds of corruption and abuse of office. Counsel for the EFCC, Jibrin Okutepa (SAN), argued that the respondents failed to prove the properties were acquired lawfully.

Defense’s Argument: Malami’s counsel, Adedayo Adedeji (SAN), requested the dismissal of the suit, contending that the EFCC’s case relies on suspicion rather than admissible evidence. Furthermore, the defense stated that many of the assets were acquired before Malami’s tenure as Attorney-General and that the EFCC relies heavily on extrajudicial statements.

Related Charges: Separately, Abubakar Malami, along with his wife and son, faces a 16-count charge in an ₦8.7 billion money laundering trial. The trial involves allegations of conspiracy, concealing, and laundering proceeds from unlawful activities. Proceedings for this case were previously adjourned, with a recent hearing delayed following a request from the defense.
