The plaintiffs are seeking a court declaration that the state of emergency in Rivers is unconstitutional, null, and void. They argue that the emergency declaration, and its ratification by the National Assembly, breaches Article 13 of the African Charter on Human and Peoples’ Rights (Ratification and Enforcement Act) and Section 305(3)(b) of the Constitution of the Federal Republic of Nigeria (1999, as amended).

Among their requests, the plaintiffs are seeking an order preventing the Rivers State administrator from appointing caretaker committees, establishing a state executive council, awarding contracts, or making financial transactions from the state treasury.
