The move follows a 2022 ruling by the ECOWAS Court, which deemed Section 24 of the Cybercrime Act 2015 “arbitrary, vague, and repressive,” ordering the Nigerian government to repeal it. While the 2024 amendment removed Section 24, SERAP argues the new law is still flawed due to vague provisions that could stifle free expression, particularly through terms like “cyberstalking” and the definition of “causing a breakdown of law and order” in Section 24(1)(b).

SERAP points to several cases where the law has been misused to intimidate critics, including the arrests of Dele Farotimi and Agba Jalingo, as well as other incidents where individuals were harassed or detained for social media posts. The organization contends that the amended Act violates Nigeria’s obligations under international human rights laws, such as the African Charter on Human and Peoples’ Rights and the International Covenant on Civil and Political Rights. It urges the ECOWAS Court to declare the law unlawful, demand its repeal or amendment, and ensure Nigeria’s compliance with its human rights obligations.
